Contested Conservatorship Issues

When an individual is appointed as a conservator for a family member, they are legally made responsible for making financial decisions on behalf of their loved one and managing his or her estate. Conservatorships become necessary when the family member has resources or assets that need proper management.

A conservator can become necessary for the following reasons:

  • The family member suffers from mental incapacity
  • The family member has an injury or illness that makes it impossible to effectively communicate important decisions
  • The family member is detained or otherwise unable to return to the United States
  • The family member is deemed legally missing

If your family member has not appointed durable power of attorney, the court will be responsible for selecting a conservator to act on their behalf. Sometimes, families disagree on who should be appointed conservator due to issues involving money and control.
